This is just more of what I said before about bar groups not really wanting to influence voters. Exactly what resources are lacking? Presumably, every group that puts itself into the process has a sufficiently large committee for a proper discussion that produces each rating in a responsible manner. Don’t they? Those discussions can be transcribed--heck a simple phone app can do it on the spot--and then the sufficiently large committee can split up the work and draft a proper set of summary paragraphs in an afternoon. No this is not a resource problem. Let’s put that to rest.<br /><br />If influencing voters were a priority for these groups then they’d all be completely transparent about the reasons for their ratings, the criteria and procedures that were used, and the people who produced them. A few of the bar groups do make an effort--CBA/CCL/ISBA with explanations; ISBA posts their committee roster; CCL does a nice job of presenting their procedures and criteria--but none is completely transparent and most offer nothing at all.<br /><br />Injustice Watch, whatever anyone thinks of their point of view, most of what they post is simple objective background information that none of the bar groups posts. It won’t be a popular answer, but so be it.<br /><br />The answer is No they do not want to influence voters.<br /><br />Oh sure, the groups will pay lip service to the idea that they do. And some of the members of the groups genuinely do. But when push comes to shove, and changes and new ideas need to be accepted to actually get it done, it doesn’t happen.<br /><br />From my research and observations there are two reasons why not. First, along with the commendable public-service goals that the bar groups accomplish with their work, there are other things that accrue—-things that are more internal and can be enticing. Specifically, the power and legitimacy and visibility that come from candidates and judges appearing before them and answering their questions and being held accountable to them. For many smaller groups, being in “the screening game” brings more of those things then they get with anything else they do. And so when faced with making changes to their procedures or their messaging to help communicate with voters more effectively, well if the changes might compromise those internal rewards in even the slightest way, the public good typically takes a back seat.<br /><br />The other reason is a mindset problem. A lot of people in the bar groups seem resigned to the idea that there’s nothing that can be done, and so they make no effort to seek out improvements. Others, unfortunately, refuse to accept any kind of analysis or research-driven evidence if it contradicts their own personal observations and opinions. The latter is more of a problem with older attorneys than with younger ones who tend to be more open to new ideas, but it has never gone away.<br /><br />One other longtime problem used to be that influencing voters more effectively would require money, and where would that money come from. But social media has obliterated that issue. And as you observe, political interests with little or no direct legal expertise are schooling the bar groups on this...and the bars aren't learning the lesson.<br /><br />Your point about finishing evaluations earlier is a good one. But the evidence shows that there are other more important things that matter. Shorter-term strategies related to presentation and pre-election day timing of information, and longer-term strategies for voter education. Strategies proven to work by history and by analysis.
