Inadvertent omission: IVI-IPO endorsements in Republican judicial contests

I didn't look for a second page and, therefore, I missed the IVI-IPO's endorsements in two Republican judicial primary races.

I apologize for my inadvertent omission and thank Harry J. Fournier for calling this to my attention.

Of course, he has a particular interest in correcting my mistake: The IVI-IPO endorsed Fournier in his 4th Subcircuit race (for the Riley vacancy). (Fournier will be unopposed on the March primary ballot; his opponent was recently ruled off the ballot.)

The other IVI-IPO endorsement in a Republican race comes in the race for the Pietrucha vacancy in the 13th Subcircuit. Here, the IVI-IPO backs Nicholas G. Grapsas (whose name I have heretofore misspelled -- that error has also been corrected).

Michael F. Otto appointed to Circuit Court bench

The Illinois Supreme Court has appointed Jenner & Block attorney Michael F. Otto to the vacancy on the Cook County Circuit Court that will be created by the pending retirement of Judge Dennis J. Burke.

According to his biography on the Jenner & Block firm website, Otto was first licensed in Missouri in 1995, becoming an Illinois attorney in 1998. Before joining Jenner, Otto served as a law clerk to Supreme Court Justice Charles E. Freeman (from 1999-2007). Before that, Otto was a clerk to Appellate Court Justice Joseph Gordon.

Otto received special recognition for his pro-bono advocacy from the Family Defense Center at its September 2011 benefit. Otto also currently serves as the Chair of the Chicago Bar Association Class Litigation Committee.

Otto's appointment is effective February 15, 2012 and terminates December 1, 2014.

49th Ward Dems announce endorsements

The Democratic Party of the 49th Ward has announced its endorsements for the March 20 primary.

The link will take you to the post on Committeeman David Fagus's blog in which you'll find the complete list of candidates endorsed.

In the races for the two vacancies in the 9th Subcircuit, the 49th Ward has chosen to endorse Judge Lionel Jean-Baptiste for the Bender vacancy and Abbey Fishman Romanek for the Epstein vacancy.

The 49th Ward Democrats also considered candidates for the Supreme Court. Justice Mary Jane Theis was the choice of 54% of those voting at Monday night's screening session. Justice Joy V. Cunningham received 38% of the votes, however, and, according to Mr. Fagus's blog post, a candidate must receive 66.7% of the votes in order to be endorsed by the organization. According to Fagus's post, "Races in which no candidate received 66.7% of the vote will be refered to the Board of the Democratic Party for additional consideration and an endorsement may be made."

These were the only judicial races to come before the 49th Ward organization's endorsement session.

There was one other endorsement, in a non-judicial race, that may nevertheless be of some interest to judges and lawyers who happen across this post: Incumbent Clerk of the Circuit Court Dorothy Brown received only 2% of the vote at the 49th Ward endorsement session. Ald. Ricardo Muñoz was the choice of the other 98% and was therefore endorsed.

Adams, Lacey survive Electoral Board challenges

The Cook County Clerk's website now confirms that the objections to the candidacy of 9th Subcircuit candidate David C. Adams have been overruled. Pending any possible appeal, Adams' name will appear on the March 20 Democratic Primary ballot.

Adams is a candidate for the Eptstein vacancy in the 9th Subcircuit candidate. Also in the field for that vacancy are Judge Mary S. Trew (who was appointed to this vacancy by the Illinois Supreme Court), Abbey Fishman Romanek, and Associate Judge Larry Axelrood.

No Republican filed for the Epstein vacancy. The winner of the March 20 primary in this race will almost certainly be elected in November.

I previously reported here that one of the challenges to countywide judicial candidate Sammy W. Lacey Jr. had been overruled. Two other challenges to Lacey's candidacy have now been withdrawn, according to the Cook County Clerk's website, clearing Lacey to appear on the March 20 primary ballot.

Lacey is a candidate for the Stewart vacancy. Also in the race for this seat are Judge Pamela M. Leeming, Terrence M. Jordan, Deidre Baumann, Mary Margaret Burke, Rhonda Salleé and Steve Demitro.

There is no Republican candidate for this countywide vacancy (or for any other countywide Circuit Court or Appellate Court vacancy). The winner of the March 20 primary in this race will likewise be almost certainly elected in November.

Crowded field remains in 4th Subcircuit race after Reggi withdrawal

There is still one more candidate withdrawal to report this morning.

Martin D. Reggi has dropped his bid for the "A" vacancy in Cook County's 4th Judicial Subcircuit. The Cook County Clerk's office confirms that his name will not appear on the March 20 Democratic Primary ballot.

But 4th Subcircuit voters will still have several choices in this race. Remaining in the field are Julie Line Bailey, Karin Elizabeth Swanson, Linda A. Walls, and Edward M. Maloney.

The winner of the Democratic primary here will face Christine Cook in November. Cook is unopposed in the Republican primary.

William G. Gamboney now unopposed for Terrell vacany in 7th Subcircuit

The Illinois State Board of Elections confirms that Pamela Reaves-Harris has withdrawn from the race for the Terrell vacancy in Cook County's 7th Judicial Subcircuit. Her name will not appear on the ballot. This leaves Oak Park criminal defense attorney William G. Gamboney as the sole remaining candidate for this vacancy.

No Republican filed for this vacancy, meaning that Gamboney is virtually assured of taking the bench after the November election.

Justice Tully withdraws from Supreme Court race

The Illinois State Board of Elections website this morning confirms that former Appellate Court Justice John P. Tully has withdrawn his bid for the Illinois Supreme Court.

Sources in the Cook County Clerk's office confirm that, even though Justice Tully's withdrawal was posted this week, his name will not appear on the March 20 primary ballot.

Four candidates remain in the Democratic primary race for the opening created by the retirement of Justice Thomas Fitzgerald, Justice Mary Jane Theis (who was appointed to the Supreme Court to succeed Justice Fitzgerald), Appellate Court Justice Aurelia Pucinski, Appellate Justice Joy Virginia Cunningham, and Chicago attorney Thomas W. Flannigan.

The winner of the Democratic primary will face Circuit Court Judge James G. Riley in November. Judge Riley is unopposed in the Republican primary.

Sun-Times refusal to make any endorsements will hurt good judicial candidates

Robert Feder is among the many questioning the wisdom of the decision by the Chicago Sun-Times (announced yesterday) to make no endorsements. In its signed editorial (linked in the preceding sentence), the Sun-Times stated, "Research on the matter suggests that editorial endorsements don't change many votes, especially in higher-profile races."

While this may be so in "higher-profile" races, research in judicial races has shown that newspaper endorsements can be worth tens of thousands of votes.

As Mr. Feder said last evening, in a Time Out Chicago post entitled No endorsements: Sun-Times move casts voters adrift, "Even if voters are adequately informed about top-of-the-ballot races (which itself is debatable), that's hardly the case for lower positions or judicial candidates."

The Sun-Times says it will "post assessments made by respected civic and professional groups, such as the Chicago Bar Association’s guide to judicial candidates." It promises also to post questionnaire responses (although it is not clear from the editorial whether judicial candidates will be asked to respond to questionnaires -- nor is it clear whether these responses will be posted behind the pay wall the Sun-Times is constructing). If there are judicial questionnaire responses posted, and if these can be linked without running afoul of a pay wall, I'll link them here.

There can be an argument made that past Sun-Times judicial endorsements were not particularly persuasive because, in most races, there was little explanation as to why the paper favored this candidate over that one. However, readers knew, or should have realized, that the Sun-Times had reporters covering the courts, particularly the criminal courts, where reporters could get to know and formulate substantive opinions about the judicial potential of some of the attorneys handling cases there. (As a civil attorney, I was sometimes a bit miffed that ASA's and PD's and other members of the criminal defense bar automatically had a leg up in the endorsement process -- but that's another story.) Even if the bases of the paper's recommendations were not always made clear, readers had some reasonable assurance that the editors were choosing to endorse people known to them or their staff. But for the newspaper to now say that, instead of endorsing, 'we'll tell you who the CBA recommends,' is a cop-out.

The Chicago Bar Association and the 11 members of the Alliance of Bar Associations do not make endorsements. They pass on the credentials of judicial candidates, advising whether, in their respective opinions, a candidate is "qualified" or "recommended" for the bench. There will be races on the March 20 primary ballot in which each and every candidate is rated qualified or recommended by every bar association. Sadly, there may be some (a few) in which none of the candidates is rated qualified or recommended by any bar association. In either case, how can a voter use bar ratings alone to choose a candidate to support?

Where I can get a complete list, For What It's Worth will continue to report any and all endorsements from any community group, political organization, newspaper, or union as well as bar association ratings. I'll continue to try and provide a forum, in my 'organizing the data' posts (which, with any luck at all, will be up in time for early voting) to allow voters to make the most informed choices possible in judicial elections. But the Sun-Times' decision to abandon its prerogative to make endorsements is going to hurt some good judicial candidates this year.

More Cook County Electoral Board results

Harry J. Fournier will be unopposed in the Republican primary for the Riley vacancy in the 4th Subcircuit. The Cook County Electoral Board recently ruled challenger Timothy Felix Winslow off the ballot.

Two candidates for the countywide Stewart vacancy, Terrence M. Jordan and Rhonda Salleé, survived challenges before the Electoral Board and have been cleared to appear on the March 20 primary ballot.

Beatriz Santiago has survived the challenge to her candidacy in the 6th Subcircuit. Another 6th Subcircuit candidates recently turning back a challenge before the Electoral Board was Ricardo Lugo.

Also surviving Electoral Board challenges were William G. Gamboney, 7th Subcircuit (Terrell vacancy)and Judge Arthur P. Wheatley, 7th Subcircuit (Toney vacancy).

The Cook County Electoral Board has also rebuffed a challenge to the Appellate Court candidacy of Cook County Circuit Court Judge Laura Marie Sullivan, a candidate for the Cahill vacancy.

Cunningham campaign announces two fundraisers

Emails received from Sarah Cunningham advise of two fundraisers planned for Kevin Cunningham, candidate for the countywide Kinnaird vacancy.

The first of the Cunningham fundraisers is set for Tuesday, January 31, from 4:30 to 7:00pm at Ciao Ristorante, 10296 S. 78th Avenue, Palos Hills.

Tickets for this event are priced at $50, but sponsorship levels are available for $100, $250 and $500.

The second Kevin Cunningham fundraiser is set for Thursday, February 2, from 6:30 to 9:00pm, at McNally's Pub, 11136 S. Western Ave. Tickets for this event are $35 apiece or two for $50. All attendees at this event, Sarah Cunningham writes, will be entered into a raffle for White Sox tickets.

Two subcircuit races now uncontested

The Illinois State Board of Elections website confirms that Judge Thomas J. Carroll today dropped his bid to hold onto the Moore vacancy in Cook County's 3rd Judicial Subcircuit. The Supreme Court had appointed Carroll to this vacancy just this past August.

Carroll's withdrawal all but ensures the election of Daniel R. Degnan, Executive Director of the Cook County Employee Pension Fund. Although five candidates initially filed in this race, all of Degnan's would-be challengers have now withdrawn.

In the 7th Subcircuit, meanwhile, Aicha Marie MacCarthy is the sole remaining candidate for the Jones vacancy, now that Melanie Nuby has been removed from the ballot pursuant by action of the Cook County Electoral Board. MacCarthy, too, is now all but guaranteed election in the fall.

Delort fundraiser set for February 7

Recent withdrawals in Cook County subcircuit races

Judge Anthony C. "Tony" Kyriakopoulos recently dropped his bid to hold onto the seat to which he was appointed by the Illinois Supreme Court in early 2010.

Kyriakopoulos's withdrawal from the race leaves Judge Thomas R. Allen as the only candidate left for the Locallo vacancy in the 10th Subcircuit. (Although former Ald. Allen was appointed by the Illinois Supreme Court to the countywide Pucinski vacancy, he sought, and received, slating in this race instead.) Since no Republican filed in this race, Judge Allen is virtually assured of winning a full term.

Also, earlier last week, Tracey Lynn Payne withdrew her bid to be elected to the Moore vacancy in the 3rd Subcircuit. Payne's withdrawal came just days after Rosemary L. Cotin folded her candidacy in that same race.

Endorsement season opens: Blogger asks for help

Regular visitors will have noted that I've put up two sets of judicial endorsements so far. Many groups that traditionally make endorsements in these kinds of races have only just begun their endorsement process. However, I also realize that many candidates are claiming endorsements that I've not yet publicized.

I would like to publicize every Cook County judicial candidate's endorsements, but I need help and cooperation from candidates, readers and organizations making endorsements.

If the Butchers, Bakers and Candlestick-makers Union makes endorsements in all of the judicial races, and Candidate Smith tells me that s/he has secured this coveted endorsement, I have made it my policy not share Candidate Smith's happy news until I can get the entire list.

This has not always been possible. I'm not exactly sure why, but some groups seem reluctant to publicize their endorsements.

Case in point: Last week I heard from a person who is supporting a Cook County judicial candidate. This person wrote me to advise that a well-known union had endorsed the candidate supported by this person. I wrote back and asked for a list.

Over the weekend, having not heard from the candidate's supporter, I wrote the candidate directly, repeating my request for a complete list of candidates endorsed by the union. I also spent some time searching online and, eventually, found a press/PR contact for the union. I emailed this person also, advising that I'd learned that the union had made endorsements and requesting a list so that I could publicize it here.

The response I received may be accurately paraphrased thusly: "Who wants to know?" (A lot of folks instinctively don't want nobody that nobody sent; at this point, it's probably part of the native Chicagoan's DNA.) But, additionally, the response also asked, "Who told you?"

You will note that I have not identified either the candidate or the union in this post and I will not. Nor did I identify the candidate in question to the union representative. I have no desire to embarrass either the candidate or union.

It may well be the case that the union leadership needs to advise its rank and file before revealing the endorsements to the public generally -- and I certainly understand that. I can wait.

But... judicial candidates seek endorsements because they want to use these in their campaigns. Voters may find endorsements relevant as they try and discern which judicial candidates are worthy of their support. Presumably organizations make judicial endorsements because they want to influence voters, or at least their voting members. So why not share the information?

According to information recently posted on the website of the Cook County Clerk, two more candidates in the crowded 6th Subcircuit field have survived electoral challenges. Pending possible appeals, recent actions by the Cook County Electoral Board have cleared both Mark V. Ferrante and Kent A. Delgado to appear on the March 20 primary ballot.

Electoral Board rules O'Neal out, Schleifer in

The Cook County Electoral Board has sustained objections to the nominating petitions of Circuit Court Judge William D. O'Neal, candidate for the Tully vacancy on the Appellate Court. Pending any possible appeal, O'Neal's removal from the March 20 primary ballot leaves Justice Terrence J. Lavin unopposed in his bid to keep the seat to which he was appointed by the Illinois Supreme Court in early 2010.

Judge Andrea M. Schleifer survived the challenge to her candidacy. Subject to any appeal, the Electoral Board's recent action guarantees Schleifer's opportunity to vie for the Rochford vacancy in Cook County's 12th Judicial Subcircuit, the seat to which she was appointed by the Illinois Supreme Court in late 2010. Unlike Justice Lavin, however, Schleifer faces four challengers in the March primary, Daniel P. Scott, Robert P. Babbitt, Michael John Halloran, and Judge James C. Murray.

January 28 fundraiser planned for Mike Dickman

LAPA makes judicial endorsements

The Latin American Police Association has announced endorsements in certain Cook County judicial races.

According to LAPA President Michael J. Chuchro, with whom I spoke earlier this afternoon, LAPA is endorsing Appellate Court Justice Joy V. Cunningham for the Illinois Supreme Court and Circuit Court Judge Jesse G. Reyes for the O'Brien vacancy on the Appellate Court.

LAPA also chose to make endorsements in only two of the many countywide Circuit Court races, singling out Cynthia Ramirez (O'Brien vacancy) and Diann K. Marsalek (O'Mara Frossard vacancy). Maritza Martinez, candidate for the O'Brien vacancy in the 11th Subcircuit was the only subcircuit candidate endorsed by LAPA.

Cook County Electoral Board acts on more objections to judicial candidacies

The Cook County Board has rejected challenges to the judicial candidacies of James A. Wright (candidate for the countywide Simmons vacancy) and Rhonda Salleé (countywide Stewart vacancy), according to information recently posted on the website of Cook County Clerk David Orr. Pending any possible appeal, Wright and Salleé will appear on the March 20 Democratic primary ballot.

However, the Electoral Board has sustained objections to the 12th Subcircuit candidacy of Jennifer Bae. Bae's name will not appear on the Democratic primary ballot in that north suburban subcircuit, pending the outcome of any further appeals.

A number of objections remain pending regarding other judicial candidates.

Objections to Judge Geanopoulos's petitions overruled, website found

The objections to the petitions filed on behalf of Judge Nicholas Geanopoulos were recently overruled by the Cook County Electoral Board. Pending an appeal, therefore, Geanopolous will appear on the March 20 primary ballot in the race for the Durkin Roy vacancy 8th Subcircuit.

Judge Geanopoulos was appointed to a countywide judicial vacancy in 2008. He did not run for election in 2010 but was recalled to judicial service by the Illinois Supreme Court after the expiration of his initial appointment.

Judicial candidates invited to provide statements

Although a number of candidate challenges are still pending, most of the Cook County judicial candidates have begun to turn their attention to actual campaigning – asking voters for votes.

Getting one’s message out to voters in a county as large as this one is a herculean challenge. Candidates are seeking endorsements, filling out questionnaires, and showing up at any event that will have them. Judicial candidates spend a lot of time seeing... each other. I’d like to give every Cook County judicial candidate the opportunity to get his or her message directly to potential voters.

I will print any statement that any judicial candidate cares to make right here on For What It’s Worth. This is the third election cycle in which I’ve extended this invitation. In 2008, more than two dozen candidates took me up on the invitation. In 2010, only a few candidates did. I’m happy either way.

Candidates need only send me an email (there’s a link in the sidebar of this blog) with their essay.

Candidates: You can send me a statement of personal philosophy, the stump speech you’ve always wanted to make, the pitch you’d like to make at every voter’s front door, or whatever else you think appropriate. I’m not going to tell anyone what to say or how. (I would guess, however, that it might be more persuasive to explain why you are the best choice, keeping in mind, as my mother used to say, that you don’t make your own candle shine brighter by trying to blow out someone else’s.)

If I don’t already have your picture, send me a head shot. I’ll run that with the post. I will not edit candidate statements. I’ll print what you send. (That’s why I need an email, to verify what was sent, and by whom.) To see what other candidate statements have looked like, click on the “In Their Own Words” tag at the bottom of this post. I will only put up one statement per candidate.

I know some candidates have statements of the types solicited here on their own campaign websites. If a candidate asks me to run a substantially similar statement here, or even the same statement, I will do so. I will not pull statements from candidate sites on my own, however. If a candidate wants me to put their statement here, the candidate has to send me the statement.

I know writing such an essay won’t necessarily be an easy task: As lawyers, we’re used to advocating for a client -- for someone else. It’s not as easy to talk about ourselves. But this will be an opportunity for candidates to define themselves, rather than be defined by questionnaire responses.

I do not intend to impose any limit on the statement’s length; presumably no serious candidate would compose anything overwhelmingly long. For illustration purposes, my word processor assures me that this post is 486 words long.

Electoral Board rules on several candidate objections; others withdrawn

The remaining objections have been dropped against 2nd Subcircuit judicial candidate Alma Learetta Tyson, according to the Cook County Electoral Board (information posted on the website of Cook County Clerk David Orr).

According to the County Clerk's website, the Cook County Electoral Board has overruled objections to the judicial candidacies of Aicha Marie MacCarthy (7th Subcircuit - Jones vacancy), Judge Michael Ian Bender (Bender vacancy), and Terry Gallagher (4th Subcircuit - Riley vacancy).

Objections have also recently been withdrawn to the candidacy of Steve Demitro (countywide - Stewart vacancy). The Electoral Board has also overruled objections against three other candidates vying for the Stewart vacancy. Pending possible appeals, challenges to the nominating petitions of Judge Pamela M. Leeming, Mary Margaret Burke, and Sammy W. Lacey, Jr. have all been denied.

Because the objections against him have been withdrawn, Demitro's name will appear on the March 20 primary ballot. Pending possible appeals, Burke and Leeming are now also cleared to appear on the ballot.

Lacey's position is slightly different. Although one of the three challenges against his candidacy has been resolved in his favor, there are two other challenges still pending.

The Cook County Electoral Board recently sustained objections against a number of judicial candidates. Candidates against whom objections are sustained are effectively knocked off the ballot unless reinstated via an appeals process.

Objections have been sustained against Frank James Ryan (countywide - O'Brien vacancy), Martin Walter Burzawa (6th Subcircuit - Delgado vacancy), and Marianne G. Dwyer (8th Subcircuit - Cole vacancy).

The Cook County Bar Association hosted a symposium last night for all of the candidates running for the Fitzgerald vacancy on the Illinois Supreme Court in the Powers, Rogers & Smith Ceremonial Courtroom at the Loyola University Law School.

Lawyers would not expect a great deal of news to be generated by a symposium of this type, and there wasn't. Mr. Flannigan repeated, as he has on prior occasions, that he will not accept campaign donations. Justice Tully said he would. Justice Theis voiced concern about how campaign money has played an increasingly caustic role in some recent judicial elections. All the candidates were in favor of getting qualified judges on the bench. All the candidates were in favor of diversity. And, here's a shocker, seeing as how the candidates were speaking at an event put on by one the area's major bar associations: All the candidates stressed how much they like and respect bar associations and promised (to slightly varying degrees) to work closely with bar associations after election to the Supreme Court on matters of judicial, staff, and committee appointments.

To most voters, this may seem pretty boring. Yet, in my opinion (clearly labeled as such), Robert Jordan was absolutely correct when he said it was too bad that last night's program could not have been broadcast on television. Let me explain.

It would be interesting, of course, to hear the candidates' views on pension reform, for example, or tollway expansion, or school closings. But any judicial candidate foolish enough to venture an opinion on these (or any other 'hot-button' political issue) might be found to have violated Supreme Court Rule 67A(3)(d)(i) (Canon 7A(3)(d)(i) of the Code of Judicial Conduct) which prevents any judicial candidate from making "statements that commit or appear to commit the candidate with respect to cases, controversies or issues within cases that are likely to come before the court."

Yet it would be extremely informative, I think, for voters to see how judicial candidates respond to even the rather vanilla questions that they can answer. Does the candidate appear organized, wise, humble, pleasant, self-deprecating, anxious, arrogant, nervous, uncertain...? Does the candidate show respect for the questions and the questioners? The text of a candidate's answers, no matter how faithfully reported, may not accurately reflect the impression the candidate makes in person. This is why reviewing courts typically defer to trial judges or juries on questions of witness credibility. Yes, the appellate courts have the record of everything the witness said -- but the trial court and/or jury could observe how the witness testified, the tone of voice, the eye contact, the general demeanor and body language of the witness that combined together to give the trial judge or jury an impression of the truthfulness of that witness. A trial judge or jury determines the credibility of a witness based on personal observation. You, the voter, should determine whether this candidate or that one makes a credible case for going onto (or remaining on) the bench.

In other words, if you have the opportunity to attend a future candidate symposium, for judicial candidates at any level, you should make every effort to attend. I will make every effort to publicize in future posts any candidate forum of which I become aware. Perhaps WGN (or its cable sibling CLTV) will find occasion to broadcast a future symposium. In the meantime, WGN should be commended for mentioning last night's event on its flagship 9:00pm newscast (and even providing some video of the event). That minute or so was about a minute or so more precious news time than has typically been devoted to Illinois judicial elections in recent election cycles by Chicago TV stations.

Plaudits should also be directed at Cook County Bar Association President Sharon E. Strickland, Loyola Law Professor Neil Williams and all the other organizers of last night's event. Some of these are shown here, posing with the candidates who were able to remain after the symposium ended.

Some judicial candidate objections withdrawn, one objection sustained

Most of the objections filed against the nominating papers of many Cook County judicial candidates remain pending, but some have already been resolved, according to information posted on Cook County Clerk David Orr's website.

Objections against three of the four remaining candidates for the Stuttley vacancy in the 2nd Subcircuit (Carl B. Boyd, Arthur Wesley "Wes" Willis, and Chester Slaughter) have been dropped. One of the objections against the fourth candidate in that race, Alma Learetta Tyson, has also been dropped, but another remains pending.

The objections to Michael A. Forti's candidacy have also been withdrawn. Forti is a candidate for the countywide Simmons vacancy. Objections to Karen Lynn O'Malley's candidacy (Conlon vacancy) and Brian J. Stephenson's candidacy (Ward vacancy) have also been dropped.

An objection to one countywide judicial candidate, Gwendolyn D. Bayless, has been sustained, according to the Cook County Clerk's website, apparently by default. Bayless had been running for the O'Mara Frossard vacancy.

Courtney folds Supreme Court bid

According to the Illinois State Board of Elections website, Chicago attorney Tom Courtney withdrew his bid today for the Illinois Supreme Court.

An Illinois attorney since 2000, Courtney is a Chicago resident who practices with the Palos Heights firm of Thomas F. Courtney & Associates. Courtney was making his first bid for judicial office; he was a candidate for 27th Ward Alderman in 2011. The candidates remaining in that race are Justice Mary Jane Theis (who was appointed to the Supreme Court to succeed Justice Thomas R. Fitzgerald), Appellate Court Justice Aurelia Pucinski, Appellate Justice Joy Virginia Cunningham, attorney Thomas W. Flannigan, and former Appellate Court Justice John P. Tully.

Many more suburban holiday light recycling opportunities

A number of north and northwest suburban communities, acting together under the banner of the The Solid Waste Agency of Northern Cook County (SWANCC), are offering a free holiday light recycling program.

According to the SWACC website, Elgin Recycling is processing the material. Interestingly, Elgin Recycling is the company coordinating the holiday light recycling drive in Chicago as well processing the material. (See, the post below or follow this link for more information about holiday light recycling for Chicago residents.)

Hopefully, Elgin Recycling has figured out a way to make money from all this. There nothing wrong in doing well by doing good.

As the list below shows, residents in many north and northwest Chicago suburbs have a lot of options for responsibly disposing those burned out Christmas lights that have seemingly taken up permanent residence in so many garages, or the strings of incandescent bulbs that were finally replaced with energy efficient LED lights at the after-Christmas clearance sale. But don't bring garland or wreaths or the Christmas trees on which these lights were formerly displayed. Note too that different locations have differing dates and times on which these materials will be accepted:

Christmas tree, holiday light recycling information

The City of Chicago will again provide multiple locations at which Christmas trees will be accepted for recycling from January 7 to January 20. The locations are:

According to the City website, all ornaments, lights, and stands have to be removed before the tree can be accepted. (The trees will be mulched -- and mulch will be available for pickup at each of these sites starting January 13.)

Of course, you may have replaced some old light strings with new, more energy efficient holiday lights. The old lights need not be consigned to a landfill. The City of Chicago has made arrangements with Elgin Recycling for old Christmas lights to be accepted at these four locations:

Did Santa bring a sleek new computer, and now you need to responsibly get rid of the old one? This is no longer a matter of voluntarily doing the right thing: As of today, Section 95 of The Electronic Products Recycling and Reuse Act (415 ILCS 150/95) provides, in pertinent part:

[N]o person may knowingly cause or allow the mixing of a CED [Covered Electronic Device], or any other computer, computer monitor, printer, or television, electronic keyboard, facsimile machine, videocassette recorder, portable digital music player, digital video disc player, video game console, electronic mouse, scanner, digital converter box, cable receiver, satellite receiver, digital video disc recorder, or small-scale server with municipal waste that is intended for disposal at a landfill.

The City of Chicago has long accepted certain consumer electronics, burned-out CFLs, old batteries and so forth at its Household Chemicals & Computer Recycling Facility, 1150 N. North Branch Street. The facility has limited hours. For a list items accepted and not accepted, follow the link in this sentence.

The Illinois Recycling Association also provides this list of facilities across the State where electronics may be accepted for recycling. (Note that there are three places in Chicago in addition to the official City site for e-cycling.)

Also, as these trees will be used in their animal enclosures as natural habitats, windblocks and for enrichment they ask that you not drop off trees that have NOT been spray painted as this would be toxic for the animals.

Three more file today for Cahill vacancy

Two sitting Circuit Court judges and an attorney employed by the Cook County Public Guardian's Officer filed today for the Cahill vacancy on the First District of the Appellate Court.

Assistant Public Guardian Mary Brigid Hayes was the first to file this afternoon. Hayes has been an Illinois attorney since 1989.

Next to file was Judge James Michael McGing. McGing was elected to the bench from the 10th Subcircuit in 2006.

Last to file was Judge Laura Marie Sullivan. Judge Sullivan was elected to a countywide vacancy on the Circuit Court in 2002 and retained in 2008.

No Republican filed for this opening.

Pending challenges and withdrawals, Judge Sullivan will be listed last on the March 20 Democratic primary ballot for this vacancy. The lottery for the top ballot position will be between Judge Pamela E. Hill-Veal and Associate Judge Mathias W. Delort. A sixth candidate in the race is Judge Kay Marie Hanlon.

New at Christmas: Filings, withdrawals and a blog

New filing. Judge Kay Marie Hanlon filed for the Cahill vacancy on the Appellate Court last Thursday, becoming the third candidate in that race. Judge Hanlon presently sits in the Third Municipal District, in Rolling Meadows, where, according to Sullivan's Judicial Profiles, she presides over preliminary hearings in felony cases.

Hanlon was elected to the bench from the 12th Subcircuit as a Republican in 2004. (And here's kind of a Wheels Within Wheels thing: Hanlon beat Ellen L. Flannigan in the 2004 general election, but Flannigan would go on to win her own seat on the bench from the 12th Subcircuit in 2006. This year, Flannigan is also a candidate for the Appellate Court, seeking the O'Brien vacancy.)

Before becoming a judge, Hanlon served as an Assistant State's Attorney in Cook County for 12 years (1985-1997). After leaving the State's Attorney's Office, Hanlon headed up her own firm (from 1998-2004) until her election to the bench. From 1998-2000, according to Sullivan's Judicial Profiles, Hanlon also served as the manager of former State Representative Elizabeth Coulson's district office. I have so far been unable to find a campaign website for Judge Hanlon.

The deadline for filing for the Cahill vacancy is tomorrow.

New withdrawals. Two candidates pulled out of their judicial races Friday morning. Debra A. Seaton dropped her bid for the countywide Stewart vacancy, while Toya T. Harvey ended her bid for the Stuttley vacancy in Cook County's 2nd Subcircuit. The remaining candidates in these races are as follows:

New blog. I had an email from Wauconda attorney Timothy J. Storm who wrote to advise that he will be covering judicial races in Lake County, Illinois on his blog The Appealing Lawyer. Storm writes that there are three circuit court seats in Lake County up for election this year, all in subcircuits. There is a primary contest only in the "B" vacancy in the 3rd Subcircuit of the 19th Circuit, Storm says, where "current Associate Judge Thomas Schippers is up against attorney Todd Brian Projansky." Unlike Cook County, however, there will be general election contests for all three Lake County seats.

If you are an Illinois voter in Lake County, swept here by your search engine, you may wish to follow the link to Mr. Storm's blog (I've also added a link to Mr. Storm's blog in the Lawyer Blogs and News Feeds section on the Sidebar; you'll probably have to scroll down a bit to find it.)

Daniel T. McCarthy, who filed as a Republican for the Rochford vacancy in the 12th Judicial Subcircuit, withdrew his candidacy today. That leaves James Paul Pieczonka as the sole Republican candidate in the March primary. He will face the winner of the 6-way Democratic primary. The Democratic field includes:

Neville appointed to Cahill vacancy; two file for the seat; Palmer assigned

The Illinois Supreme Court announced today that P. Scott Neville, who has been serving on the Appellate Court since 2004 pursuant to Supreme Court assignment, has now been appointed to the Cahill vacancy. Justice Neville is already a candidate for the Gallagher vacancy on the Appellate Court; he has been a Circuit Court Judge since 1999.

Two judges filed for the Cahill vacancy today, the first day of the special judicial filing period. (The Cahill vacancy is the only Cook County judicial vacancy involved in this special filing period.) Associate Judge Mathias Delort filed as expected. Also filing was Circuit Court Judge Pamela Hill-Veal. Judge Hill-Veal was the candidate slated by the Democratic Party in 2010 for the O'Malley vacancy. She's running against the party this time; Judge Delort is the slated candidate in this race. FWIW has heard of as many as three other candidates who may still be circulating petitions for this race (the special filing period closes a week from tomorrow, December 27).

Justice Neville's appointment to the Cahill vacancy created an opening to which a Circuit Court judge may be assigned, and the Supreme Court filled that vacancy immediately by assigning Circuit Court Judge Stuart E. Palmer to the Appellate Court. At the time of his assignment to the Appellate Court, Judge Stuart E. Palmer was serving in the Chancery Division. According to the press release issued today by the Supreme Court, Judge Palmer "was screened in 2009 by bar associations for a potential appointment to the Appellate Court and received high marks, including a 'well qualified' rating from the Chicago Council of Lawyers and highly qualified ratings from several other bar groups, including the Chicago Bar Association and the Illinois State Bar Association."

Three more Circuit Court candidates withdraw

Paul O. Otubusin folded his candidacy for the Stuttley vacancy in Cook County's 2nd Judicial Subcircuit, withdrawing from the race yesterday afternoon, according to the Illinois Board of Elections website.

According to the ISBE, Peter Martin Kramer also withdrew from his bid for the countywide O'Brien vacancy on Friday afternoon, while James Patrick Doran withdrew from the race for the McSweeney Moore vacancy in the 3rd Subcircuit on Thursday.

Lottery results in crowded subcircuit races

If the top ballot position translates to votes in judicial races (and experience teaches this is so), I would assume that the effect is magnified in more crowded races, particularly in subcircuit races, the races furthest down the ballot. (If my assumption is incorrect, I know I can count on experts like Albert J. Klumpp, PhD, to correct my misunderstanding.)

The focus of this post, therefore, is on lottery results in subcircuit races with three or more candidates. There are a lot of crowded races in the subcircuits -- but not all of them were concerned with the lottery drawing yesterday. In the 3rd Subcircuit (McSweeney Moore vacancy), for example, although there are presently five candidadtes, Judge Thomas J. Carroll was assured the top ballot position because he was the only candidate for that race when the doors at the Illinois State Board of Elections opened on the first day of candidate filing. So the list of multi-candidate races that follows is not exhaustive; it only addresses instances where the lottery drawing concerned two or more of the contenders.

Lottery results in the Supreme Court race, contested Appellate Court vacancies

Ballot order was determined today by the Illinois State Board of Elections for the race to succeed Justice Thomas R. Fitzgerald on the Illinois Supreme Court and in four of the six contests for seats on the First District on the Illinois Appellate Court. (One of the other two vacancies just opened up, the other is uncontested.)

Justice Mary Jane Theis (who was appointed to the Supreme Court to succeed Justice Fitzgerald) drew the top ballot position. Appellate Court Justice Aurelia Pucinski has the second position, while Appellate Justice Joy Virginia Cunningham wound up in the third position.

Attorney Thomas W. Flannigan has the fourth position on the ballot. Former Appellate Court Justice John P. Tully will be the fifth candidate on the ballot. Attorney Tom Courtney would be the last candidate on the ballot in this race. An Illinois attorney since 2000, Courtney is a Chicago resident who practices with the Palos Heights firm of Thomas F. Courtney & Associates. Courtney is making his first bid for judicial office; he was a candidate for 27th Ward Alderman earlier this year.

Objections have been filed to both Tully's and Courtney's nominating petitions.

Circuit Court Judge James Gerard Riley filed as a Republican in this race. Judge Riley, the Supervising Judge of the Probate Division of the Circuit Court of Cook County, is the only Republican to file for any Cook County judicial vacancy.

The goal of all these night owls was to qualify for this year's ballot lottery -- the drawing to determine who would get the coveted first position on the ballot. Everyone in line when the doors officially opened at 8:00am was eligible.

The lottery is important because experience shows that the first position is worth v-o-t-e-s.

The lottery was held today. While there may yet be changes, whether because of successful ballot challenges or voluntary withdrawals, the ballot order is otherwise set in the eight contested races for seats on the Cook County Circuit Court. Attorney Eileen O'Connor has dropped her bid for the Tully vacancy on the First District of the Illinois Appellate Court. The Illinois State Board of Elections website confirms that O'Connor withdrew from that race late yesterday afternoon.

O'Connor's departure from the race leaves appointed Justice Terrence J. Lavin in a head-to-head contest with Circuit Court Judge William D. O'Neal.

Today is also the day that ballot order will be determined: All the candidates who were in line when the doors opened at the State Board of Elections on November 28 are eligible for the lottery that will determine who gets the coveted first place on the ballot.

I'll report later today or tomorrow on the lottery outcome.

Many other judicial candidates also face Objections

There are six candidates for the Stuttley vacancy in Cook County's 2nd Judicial Subcircuit. Objections were filed to each candidate's nominating papers yesterday.

There are only two candidates vying for the Jones vacancy in Cook County's 7th Subcircuit, Aicha Marie MacCarthy and Melanie Rose Nuby. Objections were filed to both of their nominating papers yesterday as well.

Similarly, in the race for the 7th Subcircuit Terrell vacancy, objections were filed against the nominating papers of both declared candidates, Pamela Reaves-Harris and William G. Gamboney.

Objections were filed to candidates' petitions in many, if not most, of the Cook County judicial races, but these races are noteworthy in that each and every candidate's right to appear on the ballot has been challenged.

The filing of Objections to a candidate's nominating papers does not necessarily mean that the objections are well-founded or that the name of the candidate against whom objections have been filed will be stricken from the ballot. However, the candidate against whom a challenge has been filed must quickly "lawyer up" to defend against the attempt. (Hopefully, most judicial candidates retained competent election counsel as one their first campaign steps -- but, in every election cycle, there seems to be a candidate or two who thinks that, armed with their own law license, they can fend off any ballot challenge that may be presented. Most of these will find that this was a mistake, and perhaps a mistake fatal to their hopes of election.)

The Objections to candidates' petitions will soon be made public on Cook County Clerk David Orr's website; at this point (at the risk of repeating myself to stress the point) the sufficiency of the challenges can not be weighed.

But, having said that, it is noteworthy that two of the candidates slated by the Democratic Party for a countywide vacancy, Michael Forti (a candidate for the Simmons vacancy) and Judge Pamela M. Leeming (a candidate for the Stewart vacancy), are facing challenges. Slated candidates generally don't have to worry about these things.

Among the many Objections filed to judicial candidates' petitions, the following (though not a comprehensive list) may be of particular interest.

The 6th Subcircuit race has eight candidates remaining after Carlos A. Vazquez withdrew from this race (and also from his bid for the countywide Stralka vacancy). Six of the remaining eight candidates (including Mark V. Ferrante and Beatriz Santiago, the candidate slated by the Democratic Party in this race) have drawn challenges; only Gregory Emmett Ahern, Jr. and Carlos Claudio did not.

A number of sitting judges will face ballot challenges in addition to Judge Leeming. In the 7th Subcircuit, Judge Tommy Brewer (Starks vacancy) and Judge Arthur P. Wheatley (Toney vacancy), face ballot access contests, as do Judge Ian Bender (9th Subcircuit - Bender vacancy) and Judge Nicholas Geanopoulos (8th Subcircuit - Durkin Roy vacancy).

However, aside from the challenge to Judge Geanopoulos' papers, there was only one other challenge to a candidate's nominating papers in any of the fourth 8th Subcircuit races. (Marianne G. Dwyer faces a challenge in her bid to appear on the ballot for the Cole vacancy.)

First District Appellate Court races simplified

The Illinois Appellate Court is divided into five districts. The First District of the Illinois Appellate Court is composed entirely of Cook County. Six justices will be elected to the First District in 2012. In five of these races, withdrawals yesterday have set the probable election match-ups.

Cahill Vacancy

This is the vacancy that just opened up because of the passing of Justice Robert Cahill and the only Cook County judicial vacancy in which filing is not yet closed (it opens next week). As reported here yesterday, Associate Judge Mathias Delort is seeking this vacancy; he has also just launched his campaign website. Delort has the backing of the Cook County Democratic Party. (Note: There are separate lists for Circuit Court and Appellate Court candidates on the side of this page; scroll down to find the list of Appellate Court candidates.)

Coleman Vacancy

Gallagher Vacancy

The candidate slated by the Democratic Party for the Gallagher vacancy is Justice P. Scott Neville, Jr.. (That's a link to Justice Howse's campaign website in the preceding sentence.) Like Howse, Neville was elected to the Circuit bench and subsequently assigned by the Illinois Supreme Court to serve on the Appellate Court. Justice Neville joined the Appellate Court in 2004; he'd been appointed to the Circuit Court in 1999, winning election in 2000.

Also seeking this vacancy is Associate Judge Marguerite Anne Quinn. (That's a link to Judge Quinn's website in the preceding sentence.) Quinn became an Associate Judge in 2007. According to her campaign website, Judge Quinn is "[d]ually assigned to the Domestic Violence Division and the Second Municipal District" in Skokie.

The third candidate in this race is Judge Patrick J. Sherlock. Judge Sherlock was appointed to the Circuit Court by the Illinois Supreme Court; he was thereafter elected in 2008. That's a link to Judge Sherlock's campaign website in the preceding sentence; a link has been added to the sidebar.

O'Brien Vacancy

Five candidates remain in the race for this vacancy, including Associate Judge William Stewart Boyd. (That's a link to Boyd's campaign website in the preceding sentence.) Judge Boyd is currently assigned to the Domestic Relations Division; he became an Associate Judge in 1998.

Also filing for this vacancy was Judge Ellen L. Flannigan. First elected to the bench from the 12th Subcircuit in 2006, Judge Flannigan sought elevation to the appellate bench in 2010. She is currently assigned to the Domestic Violence Division.

The only non-judge in this race is Clausen Miller partner Don R. Sampen. An Illinois attorney since 1975, Sampen sought election to the Circuit Court (from the 12th Subcircuit) in 2006 and several times in the 1990s. He ran for the Appellate Court in 2010.

The other two candidates in this race are Circuit Court Judge Jesse G. Reyes, who sits in the Mortgage Foreclosure/ Mechanics Lien Section of the Chancery Division, and Justice Rodolfo (Rudy) Garcia, a Circuit Court judge assigned to the Appellate Court since 2003. (That's a link to Judge Reyes' campaign website in the preceding sentence.) Garcia was elected to the Circuit Court in 1996; Reyes became an Associate Judge in 1997, winning election as a full circuit judge in 2008.

Objections were filed Monday to the nominating petitions of Justice Garcia and Judge Boyd.

Theis Vacancy

Justice Maureen Elizabeth Connors was assigned to the Appellate Court by the Supreme Court in October 2010. She was slated for this office by the Democratic Party. She is unopposed. Since no Republican filed to oppose her (no Republicans filed for any Appellate Court or countywide Circuit Court vacancy), Justice Connors is virtually assured of election.

Tully Vacancy

Justice Terrence J. Lavin was appointed to the Appellate Court in early 2010. A former president of the Illinois State Bar Association and a well-known and successful plaintiff's personal injury and medical malpractice attorney at the time of his appointment, Lavin was slated for this office by the Cook County Democratic Party.

Also filing for this vacancy was attorney Eileen M. O'Connor. O'Connor is employed by the O'Connor Law Group. She has been an Illinois attorney since 2006. This is her first bid for judicial office.

The third candidate in this race is Judge William D. O'Neal. Judge O'Neal was first elected to the Circuit Court from the 2nd Subcircuit in 1992. He's run for the Appellate Court before, including bids in 2008 and 2010. Objections were filed Monday to Judge O'Neal's candidacy.

The unexpected passing of Illinois Appellate Court Justice Robert Cahill (on December 4) created another vacancy on the First District of the Appellate Court.

The Cook County Democratic Party had pre-slated Associate Judge Mathias W. Delort for any appellate vacancy that should occur. The unexpected death of a respected jurist is an unfortunate circumstance in which to launch a campaign. But the Illinois statutes provide express instructions -- and tight timelines -- when such unhappy events take place. Accordingly, Judge Delort's campaign website went online today. Withdrawals in Cook County judicial races -- so far

By close of business today, Cook County judicial candidates who have filed petitions for more than one vacancy must decide and declare for one vacancy only.

At this hour, the Illinois State Board of Elections is reporting that Pamela McLean Meyerson has pulled out of the race for the countywide O'Brien vacancy on the Circuit Court; she will run in the 11th Subcircuit for the Urso vacancy.

On the other hand, according to the ISBE, Judge Kevin W. Horan has pulled out of the race for the Riley vacancy in the 4th Subcircuit, deciding to pursue the countywide O'Mara Frossard vacancy instead.

Perhaps the biggest surprise on the withdrawal list, however, at least so far, is that Judge Caroline Kate Moreland has decided to abandon her bid for the countywide Stralka vacancy. This was the only vacancy for which Judge Moreland filed, presumably ending her bid for election to the bench in 2012. (Judge Moreland currently serves by appointment to the countywide Stewart vacancy, but that appointment will expire next December, when the candidate elected to that vacancy takes office.)

Today is the last day for filing objections to (most) Cook County judicial petitions

And the website at the Illinois State Board of Elections is updating new Objections as they are filed throughout the day. But it is the Cook County Electoral Board that will have the first stab at evaluating the Objections made to the nominating petitions of Cook County judicial candidates. The Cook County Electoral Board is chaired by the Cook County Clerk. The other members are the Clerk of the Circuit Court of Cook County and the Cook County State's Attorney.

Eventually -- and soon -- the Electoral Board will be setting hearing on these Objections and, as that happens, I'll try and keep you up to date on how the various Objections fare. Please note: This is a fast-moving process. Early voting starts at the end of February. To accommodate challenges that may be made to the decisions of the Electoral Board, I've been advised that the Board hopes to complete its work on all Objections filed before the end of this month.

Two new candidates for Rochford vacancy in 12th Subcircuit

Two new candidates filed for the Rochford vacancy in the 12th Subcircuit on December 5, one Democrat and one Republican.

The Republican is Daniel T. McCarthy. An Illinois attorney since 1988, McCarthy works for the Chicago firm of Iwona Pankowska and Associates, P.C. He would face James Paul Pieczonka in one of only three judicial primary races open to voters taking a Republican ballot in March 2012 (one contest each in the 4th, 12th and 13th Subcircuits).

The new Democrat is Judge James C. Murray. Initially appointed to the bench in 2001, Judge Murray ran for the bench without success in 2002 and 2004. He has since been recalled to judicial service, most recently (I believe) in June 2008). Before becoming a judge, Murray was a partner in the firm now known as Katten Muchin Rosenman LLP. Before that, Murray served as an Assistant U.S. Attorney. His late father was a Chicago alderman and later a judge on both the Circuit and Appellate Courts.

Three new candidates in 8th Subcircuit

Candidates filing for judicial vacancies in the 8th Judicial Subcircuit were Thomas N. Osran (for the Chiola vacancy), Ellis B. Levin (for the Cole vacancy), and Judge Nicholas Geanopoulos (for the Durkin Roy vacancy).

Osran, an Illinois attorney since 1990, works for the Park Ridge firm of Judge, James & Kujawa LLC. He is a former Chicago Assistant Corporation Counsel. Levin has been an Illinois attorney since 1973 and is a former state legislator.

Judge Geanopoulos was appointed by the Supreme Court to a countywide vacancy in 2008. He did not run in the 2010 primary for the vacancy to which he was appointed but was recalled to judicial service when the initial appointment expired. Geanopoulos was a Cook County assistant state's attorney from 1983 to 1992. He went to work for the Vrdolyak Law Group LLC for four years after that, leaving to set up a solo practice in 2006. I did find a campaign website for Judge Geanopoulos, but it is under construction. I'll link it when it goes online.

Crowded field in 6th Subcircuit

If everyone who's filed remained on the ballot, the race for the Delgado vacancy in the 6th Subcircuit will be the most crowded on the ballot. There are nine candidates in the field to date. The first five candidates to file in this race were profiled in this post.

Filing Monday were Kent Delgado, Richard Lugo, Glenn J. Kahn, and Carlos Vazquez.

Kent Delgado is a former prosecutor, now practicing with the firm of Delgado & Tiernan, P.C. He has been an Illinois attorney since 1996.

Ricardo Lugo is Deputy General Counsel in the Clerk of the Circuit Court's office. That's a link to Lugo's campaign website in the preceding sentence; a link has been added to the sidebar. Lugo has been an Illinois attorney since 2001, but he has, according to his website, been in practice for 20 years. The first decade of his legal career was spent in Milwaukee and Racine, Wisconsin as an Assistant State Public Defender.

Glenn J. Kahn is a principal in the personal injury firm of Kipnis & Kahn, Ltd. He's been an Illinois attorney since 1991.

The ninth candidate in this race is Carlos Vazquez. There are two attorneys in Illinois named Carlos Vazquez, father and son I presume, who share offices on W. Division. One was licensed in 1986; the other was licensed in 2004. One of them filed to oppose Michael Tully Mullen and Judge Caroline Kate Moreland for the countywide Stralka vacancy; presumably it was the same Carlos Vazquez that filed in this race. Hopefully an FWIW reader will provide information about the correct Mr. Vazquez.

Contests now in every 7th Subcircuit race

There are four vacancies to be filled from the 7th Subcircuit.

Jones vacancy

Aicha Marie MacCarthy and Melanie Rose Nuby are the declared candidates in this race.

Here's a video by MacCarthy from the Westside Minister's Coalition in which she describes her credentials. MacCarthy has been an Illinois attorney since 1997.

Nuby was a 7th Subcircuit candidate in 2008; she filed for a countywide vacancy in 2010, but withdrew. (She was also a candidate from the 1st Subcircuit in 2004 and from the 7th Subcircuit Subcircuit in 2006.) An Assistant Public Defender, Nuby has been an Illinois attorney since 1994.

Starks vacancy

Judge Tommy Brewer was appointed to this vacancy by the Illinois Supreme Court and filed to keep this seat. RoxAnne L. Rochester filed to oppose Judge Brewer on Monday.

Rochester is a staff attorney with the Circuit Court of Cook County. She's been an Illinois attorney since 1989. According to her campaign website (and, yes, that's a link and one has been added to the sidebar as well), before going to work for the Circuit Court, Rochester had her own firm for a decade or so. Before that, according to her campaign website, she worked in a firm focusing "on corporate, securities and commodities law." Rochester is a director of the Women's Bar Association of Illinois.

Terrell vacancy

The Illinois Supreme Court appointed Judge Lorna Propes to this vacancy, but the Democratic Party slated Judge Propes for the Pucinski vacancy, making this an effectively open seat.

Two candidates have now filed for this vacancy. I'd previously mentioned Pamela Reaves-Harris and linked to her campaign website. Filing Monday to oppose Reaves-Harris was Oak Park criminal defense attorney William G. Gamboney. An attorney since 1977, Gamboney's client roster has included former Chicago Police Commander Jon Burge. Gamboney spent 15 years as a Cook County prosecutor before setting up his own practice in 1994.

Toney vacancy

FWIW readers will recall that the Supreme Court appointed Judge Arthur P. Wheatley to this vacancy. His campaign website is linked in the sidebar.

As of last weekend, only Mable Taylor, a 2010 candidate for the Illinois legislature, had come forward to challenge Judge Wheatley.

Two more candidates filed before the Monday deadline, however, Kimberly D. Lewis and Mark Battaglia.

Kimberly D. Lewis has been an Illinois attorney since 2001 and has served as a hearing officer for the City of Chicago. (That's a link to her campaign website in the preceding sentence; a link has also been added to the sidebar.) Her law office is located on South Western Avenue, in the Beverly community.

Mark Battaglia, the last candidate in this race, was introduced to FWIW readers in this November 20 post. His campaign website is also linked in the sidebar.

Rhonda Salleé holiday fundraiser December 14

Three new candidates file in 4th Subcircuit races

Two Democrats filed Monday for the "A" vacancy in the 4th Subcircuit; a Republican filed Monday for the 4th Subcircuit Riley vacancy.

The new Democrats are Martin D. Reggi and Edward M. Maloney.

Marty Reggi Jr. sent me an email to advise about his father's filing; he said his father is a general practitioner who's been an attorney for 31 years. Martin D. Reggi's law office is in Berwyn.

Edward M. Maloney also sent me an email. He wrote to tell me that he's been slated by the Democratic Party for this vacancy -- and also to clarify that he's not the same Edward Maloney who filed for countywide Pucinski vacancy. (That's Edward J. Maloney.) He wants to avoid any confusion.

This Edward Maloney, Edward M. Maloney, is a partner in the Skokie firm of Ahern Maloney Moran & Block. Maloney writes that his firm concentrates in "criminal defense but we are also the authors of the IICLE book on DUI defense. Because of that, I have been a speaker at over 100 bar association seminars on traffic-related issues and am the past Chairman of both the CBA and ISBA Traffic law Committees." An Illinois attorney since 1978, Edward M. Maloney does not have a campaign website yet, but he says one will be online soon.

The Republican filing for the Riley vacancy is Harry J. Fournier. Fournier, an Illinois attorney since 1997, practices as Fournier Law Firm, Ltd. Fournier's filing sets up one of the very few Republican judicial primary contests in Cook County. (There are potential Republican contests in one 12th and one 13th Subcircuit race as well.)

Filing Monday for the McSweeney Moore vacancy in the 3rd Subcircuit were James Patrick Doran and Tracey Lynn Payne.

James Patrick Doran, an Assistant Illinois Attorney General, was a candidate for the Darcy vacancy in 2010. He has been an Illinois attorney since 1992. Attention judicial candidates: The Alliance wants you

This post is in the nature of a plea to unscreened judicial candidates:

Many judicial candidates were screened by the Chicago Bar Association and the 11 members of the Alliance of Bar Associations for Judicial Screening -- typically because they've run for office before or applied for associate judge.

But not all judicial candidates have been screened. Are you one of these?

Some people believe (and understandably so) that judicial candidates who refuse to submit their credentials for review by their peers are thumbing their noses, not just at their colleagues who would appear before them in court, but at the public who would pay their salaries.

Let's put it this way: Presumably, you, the judicial candidate, would not seek the office unless you felt you were able to do the job and do it well. If a bar association disagrees with your personal assessment because of some petty or private reason or bias, you have a forum here to set the record straight. And while bar association recommendations are not endorsements, once you have them, they are something you can use to persuade the voting public that your belief in your ability is grounded in fact and reality. Do yourself, and the public a favor.

I will concede that filling out the forms and appearing for an interview by your peers is stressful, particularly the first time you do it. And sentencing someone to jail wouldn't be? Deciding that the hospital's conduct did not, as a matter of law, cause a baby's deformities wouldn't be stressful?

The Alliance has been working to help Cook County voters make educated choices about judicial candidates since the 1990s. Early voting for the 2012 Primary begins on February 27. The Alliance needs time to screen candidates, to investigate their credentials, to schedule interviews, and for each of the Alliance members to deliberate thereafter and make their independent evaluations. The sooner the public learns the results of these investigations, the more helpful these recommendations can be for the general public.

Six candidates now in 2nd Subcircuit race

FWIW readers know that former 6th Ward Alderman Freddrenna M. Lyle was just appointed to the Stuttley vacancy in Cook County's 2nd Judicial Subcircuit and that she will not try and keep this seat in the upcoming primary.

You've also read here about Carl B. Boyd (at left) who is seeking this vacancy (Boyd sought the countywide Hayes vacancy in the 2010 primary and the "A" vacancy in the 2nd Subcircuit in 2006) as is Assistant Public Defender Toya T. Harvey. Another Assistant Public Defender, Arthur Wesley "Wes" Willis, filed for this vacancy on December 2.

The field doubled on Monday, when petitions were filed by Alma Learetta Tyson, Chester Slaughter, and Paul O. Otubusin.

Tyson, an Illinois attorney since 1992, has her law office in Beverly, where she focuses in family law matters, including divorce, real estate and wills and probate. Slaughter, a veteran criminal defense attorney (he's been an Illinois attorney since 1971), served a term as president of the Cook County Bar Association in the mid-80's. Slaughter was defense counsel in the "Silver Shovel" corruption case against former Ald. Jesse Evans. Slaughter and newly appointed Judge Lyle had their law offices at the same location. Otubusin has a Loop law office; he's been licensed in Illinois since 1990.

I've so far been unable to find campaign websites for either Tyson, Slaughter or Otubusin.

A cautionary tale about judicial fundraising

FWIW readers will have noted a number of posts here about judicial candidate fundraisers. Judicial campaigns ask supporters to buy tickets for $50 or $100 or $125 -- but campaigns are always willing to take more, if possible (subject to the campaign disclosure laws, of course). So most fundraisers offer sponsorship levels, just in case enthusiastic supporters have money to spare.

Some sponsorship levels are fairly bland (silver - gold - platinum); others are more creative (stalwart - hero - champion).

But creativity has its limits, as Michael W. Hoskins explains in "Commission slaps judge over fundraising solicitation," an article that appeared November 30 on IBJ.com, the website of the Indianapolis Business Journal.

Hoskins relates the sad tale of Marion Superior Judge Rebekah Pierson-Treacy. For an August fundraiser, Judge Pierson-Treacy sent an invitation with "suggested contribution levels – $150 to be designated as a 'Sustained' contributor, $250 to be 'Affirmed,' $500 to be 'So Ordered' and $1,000 for a 'Favorable Ruling.'" This drew the interest of the Indiana Commission on Judicial Qualifications. The Commission recently issued an "admonishment" to Judge Pierson-Treacy:

“There is no evidence the judge intended to barter rulings for contributions,” the public admonishment says. “Nonetheless, the content of the invitation presented a negative view of the judiciary. Although Judge Pierson-Treacy’s stated intent may have been to make the traditional graduated donation levels more entertaining, the injudicious language in her invitation likely gave the impression to members of the general public that the judge’s rulings could be influenced by campaign contributions.”

Sometimes bland is better. It's certainly safer, particularly in judicial campaigns.

New countywide judicial candidates

Only one new candidate for the Appellate Court filed since the post here Sunday. Judge William D. O'Neal, who was first elected to the Circuit Court from the 2nd Subcircuit in 1992, filed for the Tully vacancy Monday. He's run for the Appellate Court before, including bids in 2008 and 2010.

Filing Monday to oppose Michael A. Forti and Jessica A. O'Brien for the countywide Simmons vacancy was James A. Wright. That's a link to Wright's campaign website in the preceding sentence; a link has also been added to the sidebar. An Illinois attorney since 1989, Wright worked as a CPA before attending law school. He has served as Inspector General of the Illinois Tollway and later as Executive Inspector General of the State of Illinois.

A sixth candidate filed for the countywide Ward vacancy on Monday. Brian J. Stephenson, an Illinois attorney since 1988, appears to be making his first bid for judicial office, but he was the Democratic nominee for the 41st District of the Illinois State House in 2010.

There are now eight candidates vying for the countywide Stewart vacancy. I mentioned the four initial filers in this post and two subsequent filers in this post. Assistant Public Defender Debra A. Seaton joined the fray on Monday. This will be Seaton's second bid for judicial office; she also sought a countywide vacancy in 1998.

Also filing Monday was Steve Demitro. That's a link to Demitro's campaign website; a link has been added to the sidebar. Demitro has been an Illinois attorney since 2000.

There are two attorneys in Illinois named Carlos Vazquez, father and son I presume, who share offices on W. Division. One was licensed in 1986; the other was licensed in 2004. One of them filed to oppose Michael Tully Mullen and Judge Caroline Kate Moreland for the countywide Stralka vacancy. Hopefully an FWIW reader will provide information about this new candidate.

Finally, there are two new candidates for the O'Mara Frossard vacancy. Rodrick F. Wimberly has been an Illinois attorney since 1995. He has his own firm, Rodrick F. Wimberly & Associates. Wimberly may be the only ordained minister running for judge this year. According to his campaign website, Wimberly serves as a minister at the Apostolic Church of God and as "co-facilitator of the Apostolic Church of God's Legal Ministry."

The other new candidate for the O'Mara Frossard vacancy is Gwendolyn D. Bayless. According to ARDC, Bayless has been an Illinois attorney since 1992 and is self-employed.

11th Subcircuit roundup

There were 11 candidates qualifying for the ballot and vying for a single vacancy in the 11th Subcircuit in the 2010 Democratic primary. This year, there are two vacancies in the 11th Subcircuit -- and only eight candidates between them, all filing as Democrats.

O'Brien vacancy

Judge Michael R. Clancy was appointed to this vacancy by the Supreme Court in May of this year. He filed to keep his seat. Three candidates have filed to take it away. They are Maritza Martinez, Maureen A. Murphy, and Roger Zamparo.

Maritza Martinez was one of the many 11th Subcircuit candidates in 2010. Both Martinez and Clancy have campaign websites linked from the sidebar.

Maureen A. Murphy is Senior Counsel for the Archdiocese of Chicago. An Illinois attorney since 1984, she has been with the Archdiocese since 1993. Before joining the Cardinal's legal staff, Murphy was in private practice for seven years and spent two years as an attorney for the City of Chicago.

Roger Zamparo filed for this vacancy yesterday. Zamparo tried to qualify for the ballot as an independent candidate in the 11th Subcircuit in 2010, but a challenge to his candidacy was sustained. Zamparo, an Illinois attorney since 1979, has his law office in Rolling Meadows. He had a campaign website in 2010, but it is no longer active; I've been so far unable to find a new site for Zamparo for 2012.

Urso vacancy

The Supreme Court did not fill this vacancy by appointment. Four candidates have filed.

Pamela Meyerson was an 11th Subcircuit candidate in 2010. This year, in addition to filing for the Urso vacancy, Meyerson has filed for the countywide O'Brien vacancy. She'll have to decide soon which post she will seek.

Lisa Ann Marino also filed for this vacancy; she, too, ran in the 11th Subcircuit in 2010. An Illinois attorney since 1988, Marino maintains a law office near Belmont and Harlem in Chicago. She is a former president of the Justinian Society of Lawyers.

Deborah J. Fortier, who filed for this vacancy yesterday, is a former president of the Cook County Bar Association (2006). An Illinois attorney since 1977, Fortier works as Special Counsel at Cook County Health and Hospital System.

The fourth candidate in this race is Oak Park attorney Jennifer A. Blanc. Licensed in Illinois since 1999, Blanc's office website states that her practice is in real estate, bankruptcy, probate, and estate planning. According to her office website, Blanc has also been active in the Cook County Bar Association.

I've been unable to locate campaign websites for Marino, Fortier or Blanc. Meyerson's campaign website is linked from the sidebar.

Judicial candidate filing ended today

There were a lot of new judicial hopefuls stepping forward today as the filing period ended. The new filers seem to have concentrated on particular races. We'll get to these in posts in the next couple of days.

But, first, however, it might be appropriate to stop and congratulate those individuals, all of whom will be unopposed in March -- and in November as well. In theory, an independent candidate could come forward to challenge any one of these unopposed candidates, but the obstacles to getting on the ballot are very high. Thus, presumptively elected because no one filed to run against them are:

For the Appellate Court

Justice Maureen Elizabeth Connors -- Theis vacancy

For the Circuit Court, Countywide

Judge Jean Prendergast Rooney -- Jordan vacancy
Judge Russell W. Hartigan -- Moran vacancy

For the Circuit Court, Subcircuits

Judge Laura Liu -- 8th Subcircuit -- "A" vacancy
Martin C. Kelley -- 13th Subcircuit -- "A" vacancy
Judge Regina Ann Scannicchio -- 14th Subcircuit -- O'Gara vacancy

Note that all of these individuals are Democrats -- with one exception. Martin C. Kelley, like all candidates in the northwest suburban 13th Subcircuit, filed as a Republican. On the other hand, no Republican filed filed for any of the 11 countywide Circuit Court vacancies or any of the five vacancies on the First District of the Appellate Court.

I will leave it to others to explain what this means for the health of the two party system in Cook County. What it also means is voters who fail to vote in the Democratic Party primary on March 20, 2012 will be almost completely disenfranchised; they will have no say at all in who serves as judge in Cook County. People who 'never vote in primaries' can expect, in November, to have a choice between Democratic and Republican candidates only in the 4th and 12th Subcircuits.

Mable Taylor, an Illinois attorney since 1994, filed for the Toney vacancy in the 7th Subcircuit Friday, where she will oppose Judge Arthur P. Wheatley. She was a candidate for the Illinois House in 2010.

Assistant Public Defender Arthur Wesley "Wes" Willis filed Friday for the Stuttley vacancy in the 2nd Subcircuit. He has been licensed in Illinois since 1994.

Two new candidates filed for the countywide Stewart vacancy late last week.

One of these, Rhonda Salleé, is familiar to FWIW readers. She filed Friday; her campaign website is linked in the sidebar. The other new candidate for the Stewart vacancy is Sammy W. Lacey Jr., a retired Chicago Police sergeant who has been licensed as an Illinois attorney since 2001.

The filing period for judicial hopefuls closes tomorrow.

Developments in one 4th Subcircuit race

"A" vacancy candidate Julie Line Bailey now has a campaign website. That's a link to the site in the preceding sentence; a link has also been added to the sidebar.

There are two new candidates for this vacancy since Tuesday's post about this race, Linda A. Walls and James J. Ryan. Walls, who filed Wednesday, is an Assistant State's Attorney. Ryan filed Friday; he lives and practices in LaGrange Park. An Illinois attorney since 1984, I believe Ryan was once affiliated with the Chicago firm of Schiff, Gorman & Krkljes.

A Republican also filed for the 4th Subcircuit "A" vacancy on Wednesday. Christine Cook, an Illinois attorney since 1990, is an Assistant State's Attorney.

Looking at filings (so far) for the Appellate Court

The Illinois Appellate Court is divided into five districts. The First District of the Illinois Appellate Court is composed entirely of Cook County. Five justices will be elected to the First District in 2012. Herewith a look at the men and women vying for these seats.

Coleman Vacancy

Circuit Court Judge Nathaniel Roosevelt Howse, Jr. was assigned to the Appellate Court by the Supreme Court in 2009. (At any given time, a quarter of the First District's Appellate Court's 24 justices are Circuit Court judges assigned in this manner.) Justice Howse is now seeking his own 10 year term; he was slated for this vacancy by the Cook County Democratic Party. That's a link to Justice Howse's campaign web site in the preceding sentence; a link has been added to the sidebar. (Note: There are separate lists for Circuit Court and Appellate Court candidates on the side of this page; scroll down to find the list of Appellate Court candidates.)

Opposing Howse are two Circuit Court Judges, Kathleen G. Kennedy and Patrick J. Sherlock. Judge Kennedy was first elected to the bench in 1996; she was retained in 2002 and 2008. Judge Kennedy currently serves in the Domestic Relations Division. This is her second bid for election to the Appellate Court; she also ran in 2010. I have so far been unable to locate a campaign website for Judge Kennedy.

Judge Patrick J. Sherlock was appointed to the Circuit Court by the Illinois Supreme Court; he was thereafter elected in 2008. That's a link to Judge Sherlock's campaign website in the preceding sentence; a link has been added to the sidebar.

Gallagher Vacancy

Judge Sherlock also filed for this vacancy. As noted previously here on FWIW, the law changed this year for Circuit Court candidates. Pursuant to current §7-12(9) of the Election Code, 10 ILCS 5/7-12(9), Circuit Court candidates are no longer able to file for more than one countywide and/or one subcircuit vacancy. Appellate Court candidates can still file for multiple vacancies and then decide which races to abandon at a later date.

The slated candidate for the Gallagher vacancy is Justice P. Scott Neville, Jr. Like Howse, Neville was elected to the Circuit bench and subsequently assigned by the Illinois Supreme Court to serve on the Appellate Court. Justice Neville joined the Appellate Court in 2004; he'd been appointed to the Circuit Court in 1999, winning election in 2000. I've not been able to find a campaign website for Justice Neville.

Also filing for this vacancy were attorney Tom Courtney and Associate Judge Marguerite Anne Quinn. That's a link to Judge Quinn's website in the preceding sentence; a link has also been added to the sidebar. Quinn became an Associate Judge in 2007. According to her campaign website, Judge Quinn is "[d]ually assigned to the Domestic Violence Division and the Second Municipal District" in Skokie.

Courtney, an Illinois attorney since 2000, is a Chicago resident who practices with the Palos Heights firm of Thomas F. Courtney & Associates. Courtney is making his first bid for judicial office; he was a candidate for 27th Ward Alderman earlier this year.

O'Brien Vacancy

Seven candidates filed for this vacancy including (again) Judges Sherlock and Quinn. Associate Judge William Stewart Boyd, pictured at left, has also filed for this vacancy. That's a link to Boyd's campaign website in the preceding sentence; a link has also been added to the sidebar. Judge Boyd is currently assigned to the Domestic Relations Division; he became an Associate Judge in 1998.

Also filing for this vacancy was Judge Ellen L. Flannigan. First elected to the bench from the 12th Subcircuit in 2006, Judge Flannigan sought elevation to the appellate bench in 2010. She is currently assigned to the Domestic Violence Division.

The only non-judge in the race for the O'Brien vacancy is Clausen Miller partner Don R. Sampen. An Illinois attorney since 1975, Sampen sought election to the Circuit Court (from the 12th Subcircuit) in 2006 and several times in the 1990s. He ran for the Appellate Court in 2010.

The other two candidates in this race are Circuit Court Judge Jesse G. Reyes, who sits in the Mortgage Foreclosure/ Mechanics Lien Section of the Chancery Division, and Justice Rodolfo (Rudy) Garcia, a Circuit Court judge assigned to the Appellate Court since 2003. Garcia was elected to the Circuit Court in 1996; Reyes became an Associate Judge in 1997, winning election as a full circuit judge in 2008. Garcia was passed over for slating in this race in favor of Reyes. The resulting controversy caught the attention of the Chicago Sun-Times (see, for example, "Judge: Berrios shunned me for ruling against his daughter," by Abdon Pallasch, Nov. 22, 2011, 2011 WLNR 24456132).

Theis Vacancy

Justice Maureen Elizabeth Connors was assigned to the Appellate Court by the Supreme Court in October 2010. She was slated for this office by the Democratic Party. She is presently unopposed.

Tully Vacancy

Judge Caroline Kate Moreland files for Stralka vacancy

Judge Caroline Kate Moreland was passed over by the Democratic Party slatemakers for the countywide Stewart vacancy. That's the seat to which she was appointed in September 2010 by the Illinois Supreme Court.

Michael Tully Mullen is the candidate slated by the Democrats for this vacancy and the only other candidate in this race so far. Per email received, his campaign website is still in development.

Five candidates have filed in 6th Subcircuit

As of the end of the week, five candidates had filed for the Delgado vacancy in Cook County's 6th Judicial Subcircuit.

Three are familiar to FWIW readers.

Assistant State's Attorney Gregory Emmett Ahern, Jr., Loop personal injury attorney Mark V. Ferrante, and Assistant Public Defender Beatriz Santiago all filed when the doors opened Monday morning at the State Board of Elections. Each is eligible for the top ballot position in the upcoming lottery.

Also eligible for the lottery is Carlos Claudio, pictured at left. According to ARDC, Claudio works for the Illinois Department of Employment Security. He has been licensed in Illinois since 2002.

Assistant Attorney General Martin Walter Burzawa filed for the Delgado vacancy on Friday morning. He too has been licensed as an Illinois attorney since 2002.

Ahern and Ferrante have campaign websites that are linked from the side bar. Santiago claims party slating in this race. She has no campaign website yet, but has a Facebook page. Claudio also does not appear to have a campaign website at this point, but he has a Facebook campaign page. Ferrante has a Facebook campaign group page. Although I'm sure there must be all sorts of technical distinctions, please don't ask me to try and explain the differences between these types of Facebook pages.
